Gema Latinoamerica, S.A. de C.V., its affiliates, subsidiaries, and controlling company with commercial name BEYOND TECHNOLOGY (hereinafter BEYOND); with address at Avenida Universidad 1627, Piso 3, Torre A, Exhacienda de Guadalupe Chimalistac, Alvaro Obregon, Mexico City is responsible for the collection, use, and protection of your Personal Data.
Purpose of Data Processing
The Personal Data we collect is used for the following purposes:
In general, BEYOND collects Personal Data from You that are related or derived, either directly or indirectly, from the contractual and/or commercial relationship that links you with BEYOND and with the performance of the activities necessary to comply with the agreed obligations. When collecting and processing such information, BEYOND undertakes to observe and abide by the principles of legality, consent, information, quality, purpose, loyalty, proportionality, and responsibility. Thus, the data requested by BEYOND are collected lawfully in accordance with the law by obtaining your consent, collecting only and exclusively the relevant and necessary data to comply with the obligations acquired. We also inform you that BEYOND has implemented administrative, technical, and physical security measures to protect your data, including sensitive personal data, to guarantee the confidentiality and security of the information you provide us. The Personal Data you provide to BEYOND will be compiled and stored in a database exclusively owned by BEYOND.
Clients and potential clients: the information is used to perform document review processes, financial analysis, credit history research, contact, and consultation. In case you are approved as a client, we perform credit evaluation processes, filling out the application form, registration in our system, file preparation, contracts, purchase orders, billing, collection processes, contact, service offerings and promotions, and those that are strictly necessary to comply with the business relationship with us.
Suppliers and persons interested in becoming new Suppliers: the information is used for validation of addresses, account numbers, names, as well as contact and consultation. Also, in the event that their services are required, the information is used to register the supplier in our system, prepare files, contracts, purchase orders, invoicing, payment processes, contact, requests for quotations, offers of services, and promotions and those that are strictly necessary to comply with the relationship that binds you to us.
Employees: The information collected from our employees is used for contact purposes, contract signature, registration of information in our database, creation of files, registration with the different agencies that, as an employer, we are required by Mexican law, payment processes, updates, courses, data analysis and those that are strictly necessary to comply with the relationship that binds you to us.
For the purposes mentioned above, we need to obtain the following Personal Data:
- From the Owner: Full name, place and date of birth, age, marital status, nationality, e-mail, address, telephone numbers, position, profession, last degree of studies, etc.
- When you provide them directly to us.
- When you provide us with documents such as: birth and marriage certificates, proof of address and education, military service record, identification and other official documents.
- When your fingerprint is registered for access to the facilities.
- When we obtain information from other sources that are permitted by law.

We will protect your sensitive Personal Data by establishing and maintaining effective management, technical and physical safeguards to prevent any damage, loss, alteration, destruction, use, access, or improper disclosure.

Some of our sites may use tools such as cookies, web beacons, or the like, which are small pieces of information sent through Beyond's website to your browser and stored on your computer's hard drive and used to determine your preferences at the time you log on to our site's services, as well as to track certain behaviors or activities performed by you within our sites.
In some sections of our site, we require the User to have cookies enabled, as some functionalities require cookies to function.
Cookies allow us to a) recognize when you enter our sites and offer a personalized experience b) know the personal settings of the site specified by you. For example, cookies allow us to detect the bandwidth you have selected when you enter the home page of our sites so that we know what kind of information is recommended to download and c) calculate the size of our audience and measure some traffic parameters, each browser that accesses our sites acquires a cookie that is used to determine the frequency of use and the sections of the sites visited, thus reflecting your habits and preferences, information that is useful for us to improve the contents, headlines and promotions for the User.

In that sense, your information may be shared with:
- Parent Company, subsidiaries and/or Affiliates
- Commercial allies
- Third parties with a contractual relationship with Beyond
- Third parties in charge of analysis and storage of Data
Sensitive Personal Data
Sensitive Personal Data collected may only be transferred to a third party when the consent of this notice is expressed by means of an express will (autograph or digital signature of the document) in accordance with the Law.
Means for limiting the use or disclosure of Personal Data
In accordance with the Law, we remind you that in the matter of personal data protection, you may exercise before BEYOND your rights called "ARCO" according to the following:
Access. This is the right of any individual to request BEYOND to inform him/her if any of his/her personal data is stored in its Database, as well as to know the Privacy Notice to which the processing of his/her information is subject.
Rectification. This is the right of individuals to have their Personal Data held by BEYOND corrected when it is incorrect or incomplete.
Cancellation. It is the right of individuals to request the cancellation of their personal data in possession of SONDA. The above gives rise to a blocking period, after which the deletion of the data (s) will proceed.
Opposition. It is the right of individuals to request SONDA to refrain from processing their Personal Data in certain situations.
Consent
If you do not express your opposition to the transfer and processing of your Personal Data, it will be understood that you have given your consent to do so.
Consent may be revoked only if there is no outstanding obligation to be fulfilled. To do so, you must send the request for revocation of consent to BEYOND by the means indicated below. Of the requests, the individual who wishes to exercise any of his/her ARCO rights may do so through a request that must comply, at least, with the following requirements: The name of the holder and address or other means to communicate the response to his request; The documents evidencing the identity or, as the case may be, the legal representation of the holder; The clear and precise description of the personal data with respect to which he seeks to exercise any of the aforementioned rights, and Any other element or document that facilitates the location of the Personal Data. Transfer of data. Unless otherwise instructed, as the owner of the personal data, you consent to the processing of your information by BEYOND, both within and outside the United States of Mexico , with respect to any controlling company, subsidiary, parent company, group company and/or affiliates under the control or in which BEYOND is a part, as well as those companies with which BEYOND has a contractual or commercial relationship, which operate under the same internal processes and policies.
